DataLeader.com Terms of Use |

These Terms of Use define and create an agreement between ProspectsPLUS!, Inc. (“we”
or “us”) and the end user (“you”) with respect to lists created on DataLeader.com
(“data”). By purchasing, downloading, or using Data from DataLeader.com, you are
agreeing to these Terms of Use.
With respect to access to the Data granted by us, and notwithstanding any other
terms in a basic licensing agreement, you agree to indemnify and hold ProspectsPLUS!,
Inc. harmless from and against any and all losses, claims, damages and liabilities,
including attorney’s fees, which you may suffer or incur based upon any third party
claim, charge or suit instituted against you arising out of or resulting from any
act of omission or commission by you from or connected with any product or service
based upon or derived from DataLeader.com Data.
The Data received from DataLeader.com shall solely be used for direct marketing
purposes. The purposes of direct marketing are to promote, sell, and deliver goods
and services.
Use of the Data for any of the following purposes is strictly prohibited:
1.
Identifying, locating, or verifying individuals
2.
Compiling, enhancing, verifying, supplementing adding to, or deleting from any mailing
list, geographic or trade directories, business directories, classified directories,
classified advertising, or other compilation of information which is sold, rented,
published, furnished or in any manner provided to a third party.
You agree to comply with all local, state, and federal laws and regulations applicable
to the use of the Data received from DataLeader.com.
You agree to comply with relevant Marketing Association guidelines and practices
in connection with any use made of the Data.
No marketing material, solicitation, advertisement or other communication sent or
made to persons on a list created using the Data shall make reference to any selection
criteria or presumed knowledge regarding the intended recipient of such solicitation,
or the source of the recipient’s name and address. You shall not use the Data for
purposes of mailing pornographic or sexually explicit material, chain letters, pyramid
fundraising solicitations or other similar purposes.
You understand that the Data have not been collected for credit purposes and is
not intended to be indicative of any consumer’s credit worthiness, credit standing,
credit capacity, or other characteristics listed in Section 603(d) of the Fair Credit
Reporting Act ("FCRA"), 15 USC § 1681a. You agree that you shall not use the Data
as a factor in establishing any consumer’s eligibility for:
i. Credit or insurance used primarily for personal, family or household purposes,
ii. Employment purposes, or
iii. Other purposes authorized under Section 604 of the FCRA.
You shall not access the Data if you are incarcerated in a prison or correctional
institution.
